John and Maryjane* had been married for over thirty years. They had both been living in the United States of America where they raised their three children together.

John  is a citizen of the United States and Maryjane is a dual citizen of both the USA and Australia. The couple had been to Australia on multiple occasions to visit and had decided they wanted to live in Australia permanently.

We advised the couple that they met the requirements for the grant of a Subclass 309 Offshore Partner Visa

We requested that John was granted a permanent partner visa because of their lengthy relationship.

Since John and Maryjane had been in a relationship for longer than three years when we made the application, we provided legal submissions requesting that John be granted his subclass 309 provisional partner visa and his subclass 100 permanent partner visa at the same time.

This meant he would be a permanent resident right away and would not have to make a second application.

 

Four months after lodgment, we received the grant for Peter’s permanent residency, and he is now free to travel to Australia with his wife.

Needless to say, they were delighted!!
